Smith was raised in Clay, a Nyc suburb of Syracuse. He graduated from Liverpool High School in 1987.
In 1994, he received his bachelor’s degree with honors from the State College of New York at Oneonta, and then in 1995, he graduated with a dissertation from Harvard University’s Law School.

He served as U.S. Attorney in an interim capacity following David Rivera’s departure in March 2017 till Donald Q. Cochran’s candidacy became official in September.
At Hospital Company of America, Smith was named V.P. and head of lawsuits in 2017.
From May 7, 2018, Smith was chosen to serve a four-year tenure as the lead prosecutor for Kosovo Specialized Courts in The Hague, where he is responsible for investigating war crimes from the Kosovo War, such as the prosecution of Salih Mustafa.
He was nominated to the office on September 11, 2018, and then on May 8, 2022, he was granted a second term.
